뷰티타임즈는 그동안 불법 & 불량 칼러 컨텍트 렌즈 판매를 경고하는 기사를 수차례 게제해 왔다. 그 결과 이에 대한 상당한 경각심이 생겼고, 대부분 소매점 경영주들이 신중하게 대처하고 있어 보인다. 하지만 아직도 그런 불법 제품들을 거짓으로 속이며 판매하는 업자들이 있다고 한다. 속임수 판매도 문제지만, 그걸 알면서도 매장에서 그런 상품을 취급하는 행위는 더더욱 문제가 된다. 범죄임을 인지하고도 묵인하고 동조하는 행위이기 때문에 더 큰 처벌을 받을 수 있다. 할로윈 씨즌, 특히 컬러 컨텍트에 수요가 높다. 다시 한번 경각심을 갖자는 차원에서 이 문제를 다루어 본다. <편집자주>

중국산 싸구려 제품들을 한국으로 반입하여, 그걸 재포장해서 ”MADE IN KOREA“ 제품으로 바꾸어 미국 시장에 유통시키는 경우가 아직도 횡횡하고 있다고 한다. 무서운 범죄행위에 해당된다. 컬러 컨택트 렌즈 제품은 무엇보다도 의료도구 (Medical Device)로 간주하기 때문이다. 단순 뷰티상품 (Beauty Merchandise)가 아니라는 거다. 의료도구로서 제작과정에서 특별히 요구되는 조건들이 있는데, 특히 시공부터 최종 박스 패키징까지 멸균작업과정(Sterilization process)을 거치지 않으면 안된다. 소비자들의 눈에 치명적인 세균이 감염되면 제조사-수입업체-소매점, 모두가 엄청난 배상의 책임이 주어지지 때문이다.
따라서 소매점 경영주는 제품을 취급하기 전에 반드시 체크해야할 중요한 사항이 있다. (1) 멸균작업과정을 거쳐 합법적으로 제조되었는가? (2) 합법적인 절차를 통해 FDA 승인을 받은 제품인가? (3) 수입업자 & 공급업자가 문제 발생시 책임을 지는 보험을 소지하고 있는가? 이 세가지는 반드시 아주 꼼꼼하게 챙겨야 한다는 것이다.

There are still cases of cheap products from China being imported into Korea, repackaged and labeled as "MADE IN KOREA" and distributed in the U.S. market. This is a terrifying criminal activity. This is because colored contact lenses are considered a medical device first and foremost. They are not just beauty merchandise. As a medical device, there are special requirements for the production process, especially the sterilization process from construction to final box packaging. If a consumer's eyes are infected with a deadly bacteria, the manufacturer, importer, and retailer are all liable for a huge amount of compensation.
Therefore, there are important points that retail store owners must check before handling products. (1) Is the product legitimately manufactured through a sterilization process?, (2) Is the product FDA-approved through a legitimate process?, and (3) Does the importer & supplier have insurance to cover their liability in the event of a problem? These are the three things you need to check very carefully.

<2> 보통 가짜 불법 상품을 판매하는 경우, 판매자가 가짜 서류를 보여주며 진짜인것처럼 현혹하는 경우가 많다고 한다. 가짜인지를 아주 쉽게 구분하는 방법을 몇가지 나열해 본다. (여기서‘가짜’란 뜻은 FDA가 요구하는 합법적인 제조과정이나 유통과정을 거치지 않고 판매되는 제품이라는 뜻이다)
1.Lens Package (Box)에 FDA가 권고하는 사항들이 무조건 프린트되어 있어야 한다. 특히 회사명, 주소, 전화번호가 빠져있는 경우는 물론이고, 고의로 가짜 번호를 프린트해 놓고 전화를 받지 않는 경우가 있는데 이는 100% 불법제품을 판매하는 업체다. 피해자가 발생할시 경찰의 추적을 피하기 위한 방편이기 때문이다.

<2> Usually, when selling fake and illegal products, the seller will show you fake documents to convince you that they are real. Here are some easy ways to recognize fake products. 1. The lens package (box) should have all the FDA recommendations printed on it. 2.FDA 허가 제품은 박스에 절대로 FDA LOGO를 넣어서는 안된다고 법적으로 규정되어 있다. 따라서 FDA LOGO가 박스에 프린트된 제품이라면 100% 불법렌즈임이 확실하다. 합법 제품임을 속이기 위해 FDA LOGO를 넣는다는 것이다.

3.Lens Package style를 주의하라 : FDA 인증을 받은 합법 렌즈 제조 공장은 멸균실을 이용하여 제품의 최종 패키징을 완벽하게 밀봉(Seal)처리하고 있다. 다시 말하면, 제품 패키지 자체가 완전히 밀봉처리 되어있다는 것이다. 반면, 불법 혹은 불량 렌즈 제품의 경우 스타일 박스 자체가 밀봉(Seal) 처리가 안된 패키지 박스에 들어 있고, 브렌드만 다르게 프린트해서 판매되고 있다. 그렇게 하는 이유는 수입시 정식 통관 절차를 피하기 위한 것으로 알려졌다. 즉 정식 통관절차를 피하기 위해 렌즈 따로, 블리스터 케이스 따로 , 패키지 박스 따로, 각각 분리 해서 수입해서, 미국내에서 재조립하여 패키징을 하고 있다는 것이다. 따라서 언제든 오픈하거나 닫기에 용이한 박스를 사용한다. 이렇게 렌즈를 분리해서 미국내에서 조립하는 것 자체가 불법이라는 점도 주목해야 한다. 제품의 패키징은 반드시 멸균실에서만 이루어져야 하기 때문이다.
3. Watch out for the lens package style: Legitimate FDA-certified lens manufacturing plants use sterilization chambers to completely seal the final packaging of the product. In other words, the product package itself is completely sealed. On the other hand, illegal or counterfeit lenses are sold in unsealed packaging boxes with the style box itself, and the brand is printed differently. The reason for this is reportedly to avoid formal customs clearance procedures when importing, i.e., to avoid formal customs clearance differences, lenses are imported separately, blister case separately, and package box separately, and then reassembled and packaged in the U.S. Therefore, the box is easy to open or close at any time. 4. Lens Moisture Case : 불법 렌즈들의 모이스춰 케이스들은 대부분 모두 똑 같은 사이즈들이다. 그 이유는 한 불법 유통업자가 한 싸이즈 박스를 대량 만들어 놓고 미국쪽 불법 수입업자들에게 공급할 때 각각의 수입업자의 비즈니스 로고만 박스에 프린트해주는 방식을 이용하기 때문이다. 그리고 대부분 Made in Korea로 프린트되어 있다. 이는 모두 불법 렌즈라고 보면 틀림없다. 알리바바 닷컴을 검색해보면 미국에서 판매되고있는 이런 불법 렌즈들도 상당 수 볼 수 있다. 제품 로고만 다를 뿐디스플레이 케이스까지 모두 똑같은 사이즈를 사용해서 유통시키고 있기 때문이다.
4. Lens Moisture Case: Most of the moisture cases for illegal lenses are the same size. The reason for this is that one illegal distributor mass-produces boxes of the same size and supplies them to illegal importers in the U.S., only printing each importer's business logo on the box. And most of them are printed with Made in Korea. All of these are clearly illegal lenses. If you search Alibaba.com, you will find many of these illegal lenses being sold in the United States. The only difference is the product logo, and the display cases are all the same size.

5. Certificate Liability Insurance : 불법 렌즈 제품은 판매 보험에 가입할 수도 없고, 보험사가 받아주지도 않는다. 렌즈로 인해 눈에
감염사고가 발생하는 경우, 매장 경영주가 책임을 지는 것이 아니라 제조사가 무조건 100% 책임을 진다. 일반적으로 Rosee 같은 제품의 경우 제조사가 보험에 가입되어 있고, 100% 책임을 진다. 그런데 불법, 불량 렌즈 도매업체들의 경우 가짜 보험증은 물론 Business Insurance, 심지어는 확인이 안 되는 한국의 제조사 보험증을 위조하여 갖고 다니며 매장 경영주들을 속이는 일까지 있다고 한다. 따라서 그들이 그런 보험증을 보여 주면, 무조건 해당 연락처에 직접 전화를 해서 그 보험증이 소비자들에게 렌즈를 판매한 후 감염 사고가 나면 커버해주는 Certificate of Liability Insurance 가 맞는지 꼼꼼히 확인해야 한다. 제조사 보험증의 경우는 그 제조사가 소재하는 국가에서만 사용할 수 있는 보험이거나, 미국으로 수출하는 과정에서 문제가 발생할때 제품에 대해 커버해 주는 보험일 뿐이다. 사람이 피해를 입었을 때 커버하는 상해보험이 아니라는 것이다. 무엇보다도 가장 중요한 것은 보험증에 표시되어있는 Description란에 ‘렌즈에 관한 보험‘이라는 명확한 내용이 기입되어 있는지를 꼭 확인 해야한다.<사진D> 이런 내용까지 위조를 했다면 중범죄에 해당된다.

5. Certificate Liability Insurance: Ilegal lenses are not insured for sales, nor are they accepted by insurance companies. If an eye infection occurs due to the lens, the manufacturer is 100% responsible, not the store owner. Usually, for products like Rosee, the manufacturer is insured and 100% responsible. However, in the case of illegal and bad lens wholesalers, they carry fake insurance certificates, business insurance, and even Korean manufacturer's insurance certificates that cannot be verified to deceive store owners. If they show you a certificate of insurance, you should call the contact directly and make sure it's a Certificate of Liability Insurance that covers them in the event of an infection after they sell lenses to consumers. A manufacturer's insurance policy may only be available in the country where the manufacturer is located, or it may only cover the product if something goes wrong during the export process to the United States. It's not a personal liability insurance policy that covers you in case of personal injury. <3> 공식 합법 공급업체(Dealers)가 아닌 딜러에게서 제품을 공급받는 일도 불법이다. FDA는 ‘Purchase only from Dealers‘(딜러로부터만 구입하라)는 규정을 만들어 놓고 있다. ”FDA Certificate를 공식 획득한, 수입 & 공급업체인 Rosee & Co사는 Texas의 모 업체 및 뉴욕의 모 세일즈맨 등이 허가 없이 Rosee 제품을 재 판매하고 있다“고 한면서, “Rosee Dealer가 아닌 제3자에게서 Rosee 제품을 구입해 리필하는 경우, 소비자 상해보험 등의 혜택을 전혀 받지 못한다”고 강조했다.
FDA 공인 딜러로부터만 공급 받아야
왜 이런 일이 발생하는가 기자가 질문을 던지자, Rosee사로부터 다음과 같은 답이 왔다. “모 렌즈 공급업체가 저희 Rosee 랜즈 상품을 판매하고 있는 소매 매장에서 저희 제품(Rosee)를 수거하고, 자기들의 제품을 대채하는 판매 방식을 사용하고 있다”면서, “수거한 Rosee제품을 자기들이 직접 혹은 제3자 세일즈맨을 통해서 재판매하고 있다”는 것이다. 아주 희한한 영업방식이 아닐 수 없다. Rosee사는 이에 대한 주의를 강조했다. “이런 경로 제3자 세일즈맨으로부터 구입한 Rosee 제품의 경우는 보험혜택이 전혀 주어지지 않음으로 주의를 요한다”며 “현재 그런 일을 저지른 뉴욕의 P세일즈맨에 대해 강력한 법적조치를 취해놓았다”고 덧붙였다.
렌즈는 일반 뷰티상품이 아닌 의료기기(Medical Device)라는 것을 명확히 주시해야 한다. 미국은 법을 엄격히 시행하는 나라다. 상기에 언급한 불법 & 불량 컬러 컨텍트 렌즈 구별하는 방법을 정확히 인지하여, 불법 문제로 휘말려 큰 고역을 치르는, “소 잃고 외양간 고치는 일”이 없도록 하기 바란다. 이 일은 특히 한국인들에게 강조한다. 조국과 민족의 명예가 달린 일이다. 반세기만에 지구촌의 기적을 이룬 나라, 세계 10대 경제대국을 건설한 나라를 조국으로 갖고 있는 우리다. 속임수 장사는 자기 자신은 물론 자기 가족에 대한 수치고, 조국과 민족의 명예를 더렵히는 일이다. 그런 수치스런 한국인이 되어서는 안된다는 말이다.
6. FDA Certification: The most common method used by illegal/shoddy lens suppliers is the "FDA 510K", which is only a factory manufacturing license. It is not an import & supply license for lens importers & suppliers in the US. If a vendor shows you a "510K" and says they are a legitimate supplier, it is 100% illegal. Officially authorized lens importers & wholesalers in the US have an official FDA CERTIFICATE recognized by the FDA, which they usually have to show to retailers when they supply the product. However, this is not always easy to do, so they may try to pass themselves off as legitimate suppliers by showing you their manufacturer's license, the FDA 510K. The way to verify that they are an official legal importer & supplier is to ask the salesperson to show you the official FDA site. The seller is also obligated to show it to you. The most important part of the verification process is to make sure that the company name and the product brand name on the FDA CERTIFICATE are the same. If they don't match, it's not only an illegal supplier, but also a way to avoid liability in the event of a consumer injury issue.
<3> It is also illegal to get products from dealers who are not official legal suppliers. The FDA has a "Purchase only from Dealers" rule that states. "Rosee & Co, an officially FDA-certified importer and supplier, is being resold by its parent company in Texas and its salesman in New York without authorization," the company said, adding that "if you purchase and refill Rosee products from a third party who is not a Rosee Dealer, you will not receive any benefits, such as consumer injury insurance."
